Public offer

This agreement is an offer from individual entrepreneur Oksana Mykolaivna Dulger, a business entity duly registered in accordance with the legislation of Ukraine (hereinafter referred to as the "School", "Hotspot" or "Executor"), to individuals (hereinafter referred to as "You" or "Customer") to receive the services specified in the "Services" section, under the terms provided in this agreement.

This agreement (hereinafter referred to as the "Agreement") is a contract of adhesion in the meaning of Article 634 of the Civil Code of Ukraine, its terms are the same for all customers. The Agreement is not a public contract in the meaning of Article 633 of the Civil Code of Ukraine.

Services are provided online using communication software.

Please note: this agreement applies only to the provision of services to individuals for teaching any of the online English courses listed in the "Courses" section (menu) on the website https://www.hotspot.school/en (hereinafter referred to as the "Course"), and does not govern the provision of services to legal entities or any other services to individuals.

When the term "Site" is used in the text of the Agreement, we mean the site https://www.hotspot.school/en.

Hotspot will teach you the Course if:

1. You have successfully enrolled in the Course;
2. You have paid the cost of the Course;
3. You have not been expelled from the Course for grades or failure to complete tasks.

Subject information about each Course — description, language level, syllabus, cost, payment terms, dates, duration, number of classes or hours, registration link, and other important information — is published on the relevant page dedicated to the respective Course on the Website.

If you have any questions, please contact the School from Monday to Friday, from 10:00 to 20:00 using the contact details provided on the https://www.hotspot.school/en/contacts/ page.

Groups have limited capacity, and moreover, groups in different courses are designed for participants with different levels of English proficiency. This means that you will only be able to enroll in a specific course if there are available spots and you meet the required level of English, which we determine at our discretion during our tests. Therefore, to avoid misunderstandings, we must confirm your enrollment in the course by contacting you using the details provided during registration; merely submitting your registration form for the course does not guarantee enrollment for the aforementioned reasons.

Our courses are not educational, just as our school is not an educational institution in the normative sense of these words. However, if you have enough motivation, we will provide you with knowledge and help you develop sustainable and conscious skills in speaking, writing, and listening in English.

Our School's motto is No Bullshit.

During the Course, we expect you to show sufficient motivation in classwork and during homework preparation, to be punctual and not to miss classes, and to treat the School's teachers and other students with respect.

First, the harsh truth: according to this Agreement, we really have the right to expel you, that is, to terminate this Agreement unilaterally without refunding the money you paid us. You agree to this directly when entering into this Agreement with us — in cases established by the Agreement.

For example, this may be possible if you did not achieve a sufficient average score on the test results and/or if you missed or were late for a certain number of classes. Or you are not properly completing homework for the Course, violating the attendance rules of the Courses.

More details on the School Rules (RTFM), which outline the rules/criteria for expulsion or promotion to the next language level, are specified on the page of our website dedicated to the specific course you are interested in. We will remind you and discuss the School Rules with you in the first lesson.

The School Rules are legally binding, meaning that your compliance or non-compliance may have legal consequences. The School Rules and information about the Course, as presented on the published page dedicated to this Course, are integral attachments and parts of this Agreement.

In addition to violating the terms of this Agreement, exclusion or dismissal from the Course (i.e., termination of services provided to you) without a refund of the fees you have paid may result from any manifestations of disrespect, physical and mental violence, abusive, harmful or socially dangerous behaviour, bullying, harassment, intolerance based on age, gender, race, health status, citizenship, nationality, political, religious or other beliefs, skin colour, place of residence, language of communication, origin, social and property status, as well as creating obstacles to conducting classes.

You do not have the right to use (publish, disclose, and otherwise use) personal data of third parties that have become known to you, including teachers of the Course and other students, without their consent.

The cost of the Course and payment conditions are specified on the Course page. Payment must be made by transferring funds to the School's bank account.

The contract is concluded by your joining it (accepting its terms), which the parties agreed to consider as a combination of such actions by the Client:

1. submission of an application for registration for the Course;
2. receiving confirmation of your enrollment in the Course from Hotspot (if you passed the testing and there are available places);
3. payment of the Course fee by you.

We draw your attention to the fact that throughout the entire session, your camera and microphone must be turned on and working. We also ask you to take care of the surrounding conditions (that depend on you) during the session, which may affect the learning process — both yours and other students in the group.

Please note that in case of your lateness to a specific lesson of the Course, we have the right to deny you access to this lesson in order not to interrupt the learning process of other students, therefore we ask you to be punctual.

We reserve the right to refuse to enter into a Contract unilaterally without explanation.

In the event of any changes to the Course on our part, including dates, times of its conduct, or changes in the instructor, we will notify you in advance. If as a result our Services lose interest for you, please refer to the Refund Policy outlined below.

Services are considered provided, and the Agreement is terminated after the Course is completed.

By providing your personal data, you consent to their processing in accordance with the rules and regulations of current legislation in Ukraine.

You consent to the recording of the classes you attend. The recording of classes is conducted exclusively for students who have missed the current lesson. You can obtain it if you have informed the teacher in advance about your absence.

You do not have the right to use any copyright objects (materials) provided to you or to which you gain access during the Course for commercial purposes without the consent of the rights holder.

You will have access to the training materials provided to you in your personal account throughout the duration of the Course.

By providing us with your contact details, you agree to receive newsletters, marketing or promotional materials, and other information from Hotspot, but you can opt out of receiving any or all of these messages by using the link in the relevant email.

As a general rule, we will refund you the paid amount proportionally to the number of classes that Hotspot cannot conduct due to circumstances beyond our control. At the same time, rescheduling classes to a reasonable time is not a basis for a refund.

We will refund you the payment received, proportionate to the classes not conducted within the Course, if:

• we have cancelled the Course;
• we have rescheduled the Course to other dates or times, as a result of which you lost interest in the Course.

The relevant return conditions are outlined on the page dedicated to the Course.

The School may provide the opportunity to reserve places on the Course subject to a deposit made by you in the amount specified on the Site page dedicated to the specific Course. If you exercise your right to withdraw from the Course (in accordance with the Agreement) before the date when full payment for the Course is required (before the second lesson of the Course), the School will refund your deposit in full.

Your non-attendance of the course you paid for is not considered as your refusal of the contract and does not imply a refund of the money you paid to us.

You have the right to withdraw from the Agreement at any time without explanation, and any fees paid for the Course are non-refundable unless otherwise explicitly stated in this Agreement.

We reserve the right not to refund you in cases explicitly provided for in this Contract.

This Agreement is concluded in the city of Kharkiv. The terms of this Agreement are communicated to all Customers by familiarising them with its electronic copy published on the School's website, the link to which is also included in the registration form for the Course.

Hotspot has the right to unilaterally make changes to this Agreement (including by approving a new version of the Agreement). Such changes take effect from the moment they are published in any way. For Clients who have already accepted this Agreement regarding a specific Course, its terms remain valid in the version in which they were accepted.

The parties are not liable for non-fulfillment of the terms of this Agreement in the event of force majeure circumstances. In this case, the parties must be guided by the general norms of civil legislation.

The contract is considered concluded from the moment it is accepted by the Client and is valid until the completion of the Course or until it is terminated by mutual agreement of the Parties or until one party unilaterally withdraws from the Contract for reasons provided for in this Contract and current legislation of Ukraine.
